These Terms of Service ("Terms") govern access to and use of Sensible (the "Service"), a web-based personal finance simulation platform operated by Tyler Killen ("we," "us," "our"). By accessing or using Sensible, a school, teacher, or student agrees to these Terms.
1. Description of Service
Sensible is an educational simulation tool that allows students to practice personal finance concepts — including budgeting, saving, investing, and credit — in a simulated environment using no real money or real financial accounts. Sensible is intended for use in a classroom setting under teacher direction.
2. Accounts
- Student accounts are created and managed by teachers or school administrators. Sensible does not offer public self-registration for students.
- Teachers and schools are responsible for ensuring accounts are used appropriately by their students and for any parental notifications or consents required by their district's policies.
- Account credentials should not be shared outside of the intended student.
3. Acceptable Use
Users agree not to:
- Use Sensible for any unlawful purpose or in violation of school policy
- Attempt to gain unauthorized access to other accounts or platform systems
- Interfere with or disrupt the operation of the Service
- Use the Service to transmit harmful code or attempt to compromise platform security
4. Educational and Simulated Nature of Content
All financial data, transactions, balances, investment results, and related content within Sensible are simulated for educational purposes only. Nothing on Sensible constitutes real financial activity, real financial advice, or an offer of any financial product.
No information provided through Sensible constitutes investment, tax, legal, or other professional advice for which licensure is required. Sensible should not be relied upon for real-world financial, investment, or credit decisions — users should consult a qualified financial advisor, tax professional, or attorney for guidance specific to their own situation.
5. Intellectual Property
All content, design, and functionality of Sensible — excluding student-generated data — are the property of Tyler Killen/Sensible and may not be copied, reproduced, or redistributed without permission.
6. School and District Responsibilities
Schools and districts using Sensible are responsible for:
- Determining that use of Sensible complies with their own policies, including any student data privacy agreements
- Obtaining any parental consent required under applicable law (e.g., COPPA where relevant)
- Ensuring appropriate supervision of student use
7. Disclaimer of Warranties
Sensible is provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation any warranty of fitness for a particular purpose, accuracy, or freedom from defects, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation of the Service.
8. Limitation of Liability
To the fullest extent permitted by law, Sensible and its operator shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or damages for loss of profits, revenue, data, or use, arising from or relating to use of, or inability to use, the Service, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
9. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
10. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding use of the Service, and supersede any prior agreements or representations, whether written or oral, except for any separately executed data privacy agreement between us and a school or district.
11. Termination
We may suspend or terminate access to the Service for any account found to violate these Terms or for extended periods of inactivity. Schools may request termination of their access and deletion of associated data at any time.
12. Changes to These Terms
We may revise these Terms from time to time. Material changes will be reflected by an updated "Effective Date" above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
